Sheehy IntroducesBill Aimed at “Soft-on-Crime” Judges

Senator Sheehy has introduced the Judicial Accountability for Irresponsible Leniency (JAIL) Act, legislation designed to allow civil action against judges and government entities who release violent criminals without bail.

“The most solemn duty of government is to protect its people, but too often, radical judges in far-left jurisdictions prioritize soft sentencing for criminals over common sense and public safety, allowing violent offenders to wreak havoc in our communities at the expense of innocent, law-abiding Americans,” Sheehy said. “It’s time to end the revolving door of the criminal justice system and hold accountable the government officials who refuse to uphold the law and keep American families safe.”

The bill comes in the wake of the murder of Iryna Zarutska in Charlotte, North Carolina, by Decarlos Brown, Jr., who had been released multiple times despite a lengthy criminal record. The House companion of the JAIL Act was introduced by Congressman Randy Fine (R-Fla.) in September.

Supporters argue that current judicial policies, including early release, loose probation, and minimal bail requirements, have created a “revolving door” that prioritizes offenders over public safety and the rights of victims.

Under the JAIL Act, victims of violent crime—or their immediate families—could bring civil actions against judges or government entities if a habitual violent offender released without bail harms another person. The legislation explicitly removes judicial immunity as a defense in these civil actions, allowing courts to hold judges accountable for decisions that result in further violence.

Proponents say the act seeks to ensure justice for victims and enhance public safety by placing legal responsibility on officials who fail to uphold the law in sentencing and bail decisions.
