MT Supreme Court rules W.R. Grace workers can pursue claims
MISSOULA, Mont. — The Montana Supreme Court has ruled more than 800 former employees of the W.R. Grace Company’s Zolonite Division in Libby will be able to pursue claims against W.R. Grace’s insurance company.
The workers claim that W.R. Grace’s insurer, Maryland Casualty Company, should be held liable after the company failed to warn workers about the dangers of asbestos present in the company’s vermiculite mine.
The insurer had argued that it did not have a legal obligation to warn workers of the risk posed by the asbestos, because the W.R. Grace Company held that responsibility.
